The Town of Red Hook Zoning Board of Appeals (ZBA) has affirmed the order by Zoning Enforcement Officer Bob Fennell to cease use of 210-214 Oriole Mills Road for the storage of party rental equipment and commercial dishwashing. The owner, Mitchell Bodian of TLC Acreage, had appealed the original order on the grounds that such storage could be appropriate on a farm.
However, the ZBA ruled on Sept. 12 that the property could not be considered a farm because activities on the property do not meet the definition of agricultural use in the town code.
The board also decided that the storage of party rental equipment could not be considered a farm industry in any case because, in the words of Chairman Nick Annas, “this use alters the character of the property and does not involve equipment and skills customary to an agricultural enterprise.”
